01 Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and the developer of BabyNest ("we," "us," or "our") governing your access to and use of the BabyNest: Baby Tracker iOS application ("the App").

By downloading, installing, or using BabyNest, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the app.

02 App Description

BabyNest is a personal tracking application designed to help parents and caregivers organize and log their baby's daily activities, including:

• Feeding sessions (breast, bottle, formula, mixed) including amount, duration and spit-up
• Sleep and nap sessions including start time, end time and duration
• Diaper changes including type and timestamp
• Symptom and comfort ratings across categories including breathing, digestion, appetite, and mood
• Parent notes and journal entries
• Caregiver sharing and synchronization
• Informational reflux focus areas based on logged data

03 Eligibility

BabyNest is intended for use by adults (18 years of age or older) who are parents, guardians, or caregivers of infants and young children.

By using the app, you represent and warrant that:

• You are at least 18 years of age
• You have the legal authority to agree to these Terms on your own behalf
• Your use of the app complies with all applicable laws and regulations in your jurisdiction

04 Your Account

BabyNest may be used in guest mode (no account required) or with a registered account (required for caregiver sharing and cloud sync).

If you create an account, you agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms, are suspected of fraudulent activity, or have been inactive for an extended period.

05 Subscription & Payment

BabyNest is free to download and use with core features available at no charge. Optional premium features are available through an auto-renewing subscription ("BabyNest Premium").

• Billing: Subscriptions are billed through your Apple App Store account. Payment is charged upon confirmation of purchase
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
• Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period
• Refunds: All subscription payments are processed and managed by Apple. Refund requests must be submitted directly to Apple in accordance with Apple's refund policy
• Price changes: We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance of the new price
• Free trials: If a free trial is offered, your account will be charged the subscription price at the end of the trial unless you cancel before the trial ends

06 Acceptable Use

You agree to use BabyNest only for its intended purpose as a personal baby tracking tool. You agree not to:

• Use the app for any unlawful purpose or in violation of any applicable law
• Attempt to reverse engineer, decompile or extract source code from the app
• Use the app to track any person without their knowledge or consent
• Share access credentials with unauthorized parties
• Attempt to gain unauthorized access to our servers or database infrastructure
• Use the app to transmit malicious code, viruses, or harmful data
• Impersonate any person or misrepresent your identity or affiliation

07 Your Content

You retain full ownership of all data and content you enter into BabyNest — including baby profiles, feeding logs, sleep records, notes, and symptom ratings ("Your Content").

By using BabyNest, you grant us a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of operating and providing the app's functionality. We do not claim ownership of Your Content and do not use it for any other purpose.

You are responsible for ensuring that any content you enter does not violate the rights of any third party.

08 Intellectual Property

All intellectual property rights in BabyNest — including but not limited to the app design, code, user interface, graphics, logos, feature names, and written content — are owned by or licensed to us and are protected by applicable copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use our intellectual property for any purpose other than using the app as described in these Terms.

09 Disclaimer of Warranties

BabyNest is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the app will be error-free, uninterrupted, or free of viruses
• Warranties regarding the accuracy or completeness of any content or data
• Warranties that the app is suitable for any medical, clinical, or diagnostic purpose

10 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) BabyNest.

This includes, without limitation, damages arising from:

• Loss of data or data corruption
• Reliance on any information displayed or generated by the app
• Any medical or health-related decisions made based on app data
• Unauthorized access to your account or data
• App unavailability or technical errors

In jurisdictions where limitation of liability for personal injury or consequential damages is not permitted, our liability shall be limited to the fullest extent permitted by applicable law.

11 Termination

You may stop using BabyNest at any time by deleting the app from your device. If you have an account, you may delete it from within the app's settings, which will permanently remove your data from our servers within 30 days.

We reserve the right to suspend or terminate your access to BabyNest at our discretion, including if we determine that you have violated these Terms, for legal compliance reasons, or if we discontinue the app. We will provide reasonable notice where possible.

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer is established, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of BabyNest shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

If you are located in the European Union, you may also have the right to use alternative dispute resolution mechanisms under EU law.

13 Changes to These Terms

We may update these Terms of Use from time to time to reflect changes in the app, applicable laws, or our practices. When we do, we will update the "Last updated" date at the top of this page.

For significant changes, we will provide notice through the app or via email to your registered address. Your continued use of BabyNest after such notice constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you should stop using BabyNest and delete your account.
